Terms & Conditions
§1 Scope
These Terms and Conditions apply to all contracts concerning the use of the "Menu-Check" service (the "Service") between Villiart Media (the "Provider") and the users of the Service.
§2 Service description
The Service allows uploading a menu (PDF or DOCX) and generates an AI-based audit report on the allergen declarations. The report is automated, AI-assisted guidance and does not constitute legal advice or a legally binding review. Responsibility for correct allergen labelling remains with the user.
§3 Registration and account
Use of the Service requires registration with email confirmation. Users must keep their credentials secret and provide truthful information.
§4 Prices and payment
The allergen audit is billed as a one-time payment: EUR 19.00 net plus any applicable VAT (or USD 19.00 for customers outside the EU). VAT is determined and shown automatically during checkout: customers in Germany pay 19% VAT on top; for businesses in other EU countries with a valid VAT ID, the reverse charge procedure applies (Art. 196 EU VAT Directive); consumers in other EU countries pay the VAT owed by law. Payments are processed by the payment provider Stripe. The right to have the analysis performed arises upon successful receipt of payment.
§5 Right of withdrawal
For consumers, the right of withdrawal for digital content expires when the Provider has begun performing the contract after the consumer has expressly consented to performance beginning before the end of the withdrawal period and has confirmed their knowledge that the right of withdrawal is thereby lost. The analysis starts immediately after receipt of payment.
§6 Open-source components and licences
This service is operated exclusively with open-source software. The following components are used; the respective licence texts are available via the linked project pages:
§7 Liability
The Provider is liable without limitation for intent and gross negligence as well as for injury to life, body and health. In cases of slight negligence, the Provider is liable only for breaches of essential contractual obligations, limited to the foreseeable damage typical for the contract. No warranty is given for the substantive accuracy of AI-generated reports; they are recommendations and do not replace professional or legal review.
§8 Data protection
Information on the processing of personal data can be found in the Privacy Policy.
§9 Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Should individual provisions of these Terms be invalid, the validity of the remaining provisions remains unaffected.
